Terms & Conditions

These Terms & Conditions govern all bookings with Villas Paphos (Chris Falconer T/A Villas Paphos – hereinafter described as ‘The Agent’). Any booking made by you, whether through our website or otherwise, shall be deemed an offer by you to rent the relevant villa subject to these Terms & Conditions. All bookings through us and all matters arising from them are subject to English law and to the exclusive jurisdiction of the courts of England and Wales . The person who makes the booking accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party. By submitting a booking you warrant and confirm to us that you have read these Terms & Conditions and agree to comply with them.

Liability:
In consideration of the fact that the Agent acts only as a booking agent, the Agent accepts no liability whatsoever under these Terms And Conditions, for any aspect of the arrangements and, in particular, accepts no liability for any loss, personal injury/illness or death however incurred. Although the Agent uses all reasonable endeavours to ensure the accuracy of all information provided and the quality and facilities of the villas, we cannot accept any liability whatsoever for any problems that occur while guests occupy the villa.  All information has been provided in good faith and no liability is accepted whatsoever by the Agent for any misrepresentation of villa material or accommodation.  The Villa owner or the Agent will not be liable for any loss or delay to or cancellation of your holiday due to industrial disputes, riot, threat of hostilities, political unrest, natural disasters, aircraft grounding, closure of airports, weather conditions or any other circumstances beyond their control.

Payments:
Subject to the Terms and Conditions, a deposit payment for all villas is required at the time of booking and must be received within 7 days to secure the booking.  This is 30% of the full payment (or full payment if booking within 6 weeks of the date of arrival). In the event that the Agent is unable to obtain final confirmation of availability for the selected villa a full refund of the amount paid will be made. Booking confirmation together with location/directions for the villa will be sent by email. Where an initial deposit has been paid, the balance must be paid within 6 weeks of the date of arrival, whether demanded by us or not. If this is not paid within 7 days of it being due, then subject to these Terms And Conditions, we reserve the right to cancel the villa booking without any refund.

Changes by you
Should you wish to make any changes to your confirmed booking, you must notify the Agent in writing as soon as possible. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests. Where we can, an amendment fee may be payable together with any costs incurred by ourselves.

Cancellation by you:
You  may cancel your booking at any time however, under these Terms and Conditions,  no refund will be made for any monies paid. In certain cases any loss, if incurred involuntarily, may be covered by insurance that you may have taken out. 

Changes or cancellation by the Villa Owner :
Subject to the Terms and Conditions, if deemed necessary, the Agent reserves the right to change the villa booking. In this event, you will be offered a villa of similar size and specification in the same cul de sac, if possible.   If you subsequently decide to cancel your booking, an administration fee of £100 will be payable. 
The Agent also reserves the right to withdraw or cancel the villa booking. In this unlikely event, you may be offered the choice of renting another villa through the Agent (subject to availability) with the price difference payable/refundable as appropriate, or of receiving a full refund of all monies paid to the Villa Owner. Under these Terms and Conditions, no compensation will be payable by the Agent.


Travel Insurance:
By accepting the Terms and Conditions you are also confirming that you have taken, or will take out, adequate travel insurance to cover all members of your party. Please read your policy details carefully. It is your responsibility to ensure that the insurance cover you purchase is adequate for your particular needs.  

Security:
You are responsible for the security of the villa while you are staying there, ensuring that you close windows, lock doors, close curtains and set burglar alarms (if appropriate) as failure to do this is likely to invalidate any insurance.  You are also responsible for any loss or damage to the contents of the villa that may result. 

Behaviour:
Subject to the Terms and Conditions, it is your responsibility to ensure that you and the members of your party do not behave in a way which causes offence or danger to others or which risks damage to property belonging to others. It is your responsibility to ensure that the accommodation and all its facilities are used solely by those individuals accepted for the booking and included in the party details. Any persons, other than those accepted for the booking and included in the party details, found occupying the accommodation will be required to vacate the accommodation immediately and, as a result of being in breach of the booking terms and conditions, you and your party will be required to vacate the accommodation with immediate effect. In such circumstances the Villa Owner and the Agent have the right to terminate arrangements made on your behalf, and there will be no refunds, no payment of compensation and no reimbursement of any cost or expenses you may incur as a result.  Further, you will be liable to reimburse the Agent for any expenses whatsoever incurred as a result of your behaviour.

Breakages and cleanliness:
Our accommodation is made available for letting on the understanding that the property will be left clean and tidy at the time of checkout and all personal waste must be removed from the property. It is not our policy to take any security deposit however you will be held responsible for any damage or breakages to the property caused by you or any of your party and in the event of such occurrence, the incident must be reported to the Agent immediately in order that the matter may be brought to the attention of the villa owner for immediate and appropriate compensation to be made. Clients are not permitted to move any furniture or equipment without prior written consent from the Agent or the Villa Owner.In the event of such permission being granted, it is the client’s responsibility to return the same to its original position before checkout.

Air conditioning:
Whether the cost of any air-conditioning is included in the villa price, or paid for as a supplement, the units must only be used while you are in the property, with all windows and doors kept closed. Under no circumstances must the units be left on while the property is unoccupied.

Building Work:
Any building work which may commence in the local area is outside of our control, and we cannot be held responsible for any resulting disturbance.
However, should we become aware of any building work which may reasonably be considered to adversely affect the enjoyment of your holiday under these Terms And Conditions we will notify you as soon as possible, and wherever possible will offer you the opportunity to transfer to an alternative property at the advertised price. Whilst we assure you of our best endeavours to minimize any inconvenience we regret that we cannot accept any liability in this case.

Swimming pool:
Children must be supervised at all times by parents or other responsible adults when using the swimming pool.  Use of the pool and the surrounding area is entirely at your own risk.  Diving is not permitted.

Baby Cots and Extra Beds:
We may be able to provide one baby cot and/or one extra bed. Please check with us should this be required. It should be noted that the extra bed would be of the folding 'camp bed' style and therefore may only be suitable for a child. Baby cots are usually of the portable 'travel cot' style.

Villa Check-in /Check-out times:
Access to villas will be after 3pm on your day of arrival to allow time for cleaning and servicing, and must be vacated by 11am on the day of departure.

Complaints:
In the unlikely event of a problem with your villa occurring, whilst you are abroad, you must contact the villa owner in the first instance.  Details will be provided with your arrival guide.  In the unlikely event that the problem cannot be resolved, you must inform us so that we can raise the matter with the villa owner and be put right. All claims must be addressed directly to the villa owner via the Agent.

Alterations by the Agent:
Although the Agent makes every effort to ensure that advertised descriptions are correct, we do not own any of the villas and therefore cannot control or prevent changes. Although changes to villas advertised are infrequent, the Agent reserves the right to change the description of any villa or service at any time, in which case we will endeavour to notify you of all changes before commencement of the booking date, if it is practical to do so. No compensation will be payable by the Agent in such cases. No claims will be accepted for costs or additional expenses incurred as a result of any changes.
